Terms of Service

1. Who we are

Clanker City ("the Service") is operated by xuxE creative LLC ("xuxE creative", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. What the Service is — and isn't

Clanker City helps two people divide shared belongings after a breakup. Each person talks privately to an AI agent (a "clanker"), and the clankers draft a proposed split that both people must approve.

The Service is not legal advice, financial advice, therapy, or professional mediation, and it is not a substitute for any of them. It is not for divorce, child custody, child support, or any matter governed by family law. Nothing the clankers say creates an attorney-client, fiduciary, or professional relationship. If your situation involves lawyers, courts, or safety concerns, get qualified professional help.

3. AI-generated content

Proposals and messages are generated by artificial intelligence. They may be wrong, incomplete, unfair, or unsuitable for your situation. You are solely responsible for reviewing any proposal before approving it, and for deciding whether to follow it. An approved proposal is a private understanding between the two of you — we do not guarantee it is enforceable, equitable, or appropriate.

4. Your responsibilities

• You must be at least 18 years old.
• You must provide accurate information and keep your sign-in credentials to yourself.
• You will not use the Service to harass, threaten, defraud, or harm anyone, or for any unlawful purpose.
• You will not attempt to access another person's private messages, scores, or data.
• You are responsible for the items you list and the accuracy of what you tell your clanker.

5. Payments

The person who starts a split pays a one-time fee, charged only after the clankers have agreed on a proposal, to unlock that proposal for review. Payment is processed by Stripe; we never see or store your card details. Paying unlocks the proposal — it does not guarantee the other person will approve it, and it does not guarantee any outcome. Fees are non-refundable once the proposal has been unlocked, except where required by law.

6. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, xuxE CREATIVE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PROPOSAL WILL BE FAIR, ACCURATE, OR ACCEPTED BY THE OTHER PERSON.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, xuxE CREATIVE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PROPERTY, OR RELATIONSHIPS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION YOU MAKE BASED ON A PROPOSAL, ANY DISPUTE BETWEEN YOU AND THE OTHER PERSON, AND ANY UNAUTHORIZED ACCESS TO YOUR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify and hold harmless xuxE creative LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of anyone else's rights.

9. Disputes between users

Any disagreement between you and the other person in a split — about belongings, money, property, or anything else — is strictly between the two of you. You release xuxE creative LLC from any claims arising out of those disputes.

10. Accounts and termination

You can delete your data at any time from your account page. We may suspend or end access for anyone who breaks these Terms. We may also change or discontinue the Service at any time, with or without notice.

11. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. Continuing to use the Service after a change means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to the Service will be brought in the state or federal courts located in California, and you consent to their jurisdiction.
